If the worker’s employment is terminated owing to his submitting a severe complaint with the Ministry or filing a lawsuit against the employer that is found accurate, the employer is compelled to provide a fair compensation to the worker calculated by the competent court if the dismissal is proven to be unlawful.
The amount of compensation is established by considering the nature of employment, the extent of the worker’s damage, and the length of his or her service. In all situations, the amount of compensation should not exceed the worker’s pay for a period of three (3) months, computed based on the last wage he/she received.
